Act 34: Criminal Clearance/Background Check
Prospective employees applying to engage in occupations with a significant likelihood of regular contact with children, in the form of care, guidance, supervision or training must obtain background checks as a condition of employment. These individuals, including but not limited to social service workers, psychiatrists, hospital personnel, counselors and therapists, librarians and doctors.
Pennsylvania Acts 33 and 34 require that prospective employees of agencies serving children (Act 33) and public and private schools (Act 34) present evidence to a potential employer or internship site of any criminal record with the State Police, or a statement from the State Police that such a record does not exist. Out-of-State residents must, in addition, present evidence of an FBI background check. These Acts were intended to cover employees of agencies and schools. Some agencies and school districts, acting on the advice of their solicitors, are also requiring these background checks for interns if the students involved are at least 21 years of age. Act 114: FBI Clearance/Fingerprinting
General Information: Beginning April 1, 2007, all individuals working within public and private schools, intermediate units, and area vocational-technical schools will be required to have the fingerprint-based background check. This is in addition to the regularly required clearance (Act 33 and Act 34) that must be on file.
Act 114 of 2006, Section 111 of the Pennsylvania Public School Code outlines background check requirements for student teachers and the employees of public and private schools and their contractors.
The Act requires that all student teachers (participating in classroom teaching, internships, clinical or field experience) and prospective employees (including, but not limited to: administrators, teachers, substitutes, janitors, cafeteria workers and office employees) of public and private schools, Intermediate Units and area vocational-technical schools, including independent contractors and their employees and bus drivers who have direct contact with children must provide to their employer a copy of their Federal Criminal History Record that cannot be more than one (1) year old. This applies to employees hired on or after April 1, 2007.
